Is a seller’s property disclosure still needed when a house is being sold ‘as is’?
Question: We told our listing broker that we wanted to sell our house “as is” with no repairs. Our listing broker has now brought us an offer, but this offer requires us to complete a Seller’s Property Disclosure Statement. Do we have to complete this disclosure statement if we are selling our home “as is” with no repairs?
Answer: Although legally you and the buyer could agree to no Seller’s Property Disclosure Statement, most buyers and their brokers would demand a disclosure statement even with an “as is” sale. If you were buying a home “as is,” wouldn’t you still want a disclosure statement from your seller to disclose to you any defects or other problems that your seller had during their ownership of the home?
